 Post subject: EGR Valve

Okay so I am getting everything ready for the new engine to go into the car an I noticed, I believe, the EGR valve had a bent vacuum port. Vacuum pot (EGR) mounted to the outside edge of the intake below the carb. Can this safely be removed to not use it or should I replace it? If I should replace it how do I hook it up?

Safely removed? Yes. Legally removed? Maybe, depending on your local laws and whether or not you think you can get away with dodging a Federal inspection (which rarely happens).

Most people just unbolt it and put a piece of flat steel or aluminium over the holes. If you want to keep it for a stealth look to pass a visual emissions inspection you can install it 180 degrees off and stick something in the vacuum hose leading to it to prevent any vacuum from being applied.

Emissions??? We ain't got none uh that down 'ere. lol

The way Georgia does emissions is it is by county in my county we have no emissions checks. I live in a fairly rural area.

OK, but there are Federal laws to be concerned about. For example, take the time to read this 1991 EPA information letter regarding the removal of catalytic converters on vehicles and the Federal Clean Air Act:

Even if the State of Georgia has decided that it won't bother ensuring that the vehicles operated in Georgia emit as few emissions as possible, the Federal Government also has a say in the matter and has spoken. I strongly encourage you to investigate the applicable laws before removing or disabling emissions equipment on your vehicle.

I may have left out a few details about my car. I have a slant six being worked right now for my 65 Barracuda. I am also adding a 2 barrel carb and intake. The car did not come equipped with these emissions controls they are just there because of the upgrade. I do not have any of the other related parts.

Found it. Check out Chapter 42 United States Code section 7522 section a subpart 3 (this is abbreviated in legal writing as 42 USC § 7522(a)(3)):

(a) Enumerated prohibitions

The following acts and the causing thereof are prohibited—

***

(3)

(A) for any person to remove or render inoperative any device or element of design installed on or in a motor vehicle or motor vehicle engine in compliance with regulations under this subchapter prior to its sale and delivery to the ultimate purchaser, or for any person knowingly to remove or render inoperative any such device or element of design after such sale and delivery to the ultimate purchaser; or

(B) for any person to manufacture or sell, or offer to sell, or install, any part or component intended for use with, or as part of, any motor vehicle or motor vehicle engine, where a principal effect of the part or component is to bypass, defeat, or render inoperative any device or element of design installed on or in a motor vehicle or motor vehicle engine in compliance with regulations under this subchapter, and where the person knows or should know that such part or component is being offered for sale or installed for such use or put to such use


You count as a person, and the vehicle has been sold, so under 42 USC § 7522(a)(3) you would violate the Federal Clean Air act by removing or modifying the emissions equipment on your vehicle.

Under 42 USC § 7524(a), "Any person other than a manufacturer or dealer who violates section 7522 (a)(3)(A) of this title or any person who violates section 7522 (a)(3)(B) of this title shall be subject to a civil penalty of not more than $2,500. Any such violation with respect to paragraph (1), (3)(A), or (4) of section 7522 (a) of this title shall constitute a separate offense with respect to each motor vehicle or motor vehicle engine."


Sooooo, roll the dice. Will you get caught? Probably not. Will it hurt if you do? Depends on your income bracket. Just giving you fair warning.

Oh. On a 60s era car there were no EGRs. Go ahead and remove it and block the holes with a plate.

Emission laws vary greatly from juristricion to juristriction. Reed is correct on the federal law.
When I lived in New Jersey, the state law was: The vehicle must have the OEM emission equipment for the year of the vehicle, OR the year of the engine, which ever is newer. Don't know if that is still the case.

Right. This is Federal law I am talking about, not State law. State laws are all over the place, and even vary within a particular State. Where I live we just have a State sniff test and sometimes they check the gas cap. There are other counties in Washington that have no emissions checks at all. Other States have absolutely no emissions standards. BUT! The overarching Federal law applies to everybody everywhere the US Federal Government has jurisdiction.

Like I said, a private citizen most likely won't ever get caught if they disable the emissions equipment. I am just sharing this in the spirit of spreading accurate information about Federal laws regarding emissions equipment removal.

I do appreciate the information. I never meant or intended to supersede the law but in my case having one piece without the rest would have made it complicated.

jhdeval- you are fine since you are working on a 60s era car. The only emissions devices around then were PCV valves.

Two ways to remedy the EGR situation:

1) make a blank off plate and cover the EGR port on the manifold and seal it shut.

2) Install the EGR gasket, flip the EGR upside down...this will mismatch the ports and effectively block off the EGR...it will also confuse the crap out of on lookers as 95% will not know the EGR is installed wrong.
